The Howard Jarvis Taxpayers Association (HJTA), through volunteers, is trying to get an initiative on the November 2022 ballot to repeal a portion of Proposition 19. This group is collecting signatures from registered voters to aid in this repeal effort.
In case you don't recall, Proposition 19 was on the November 2020 ballot and was promoted as help for fire victims, disabled people and seniors. That part will remain. It also included a lesser promoted provision that took away some benefits afforded by Proposition 13.
Specifically, it took away the ability to pass real estate (upon death of parents) to kids and grandkids without a reassessment, unless the property becomes the child or children’s primary residence within one year. Reassessment of long-held family properties upon death of a parent means children who can’t afford the cash to pay the new property tax bill will be forced to sell the family property.
The HJTA needs to collect 1,200,000 signatures before early April 2022 to get the initiative on the November 2022 ballot. If successful, it will be returned to Proposition 13 status with some enhancements. The proposed change also allows rental property and small businesses to be transferred without reassessment (up to $2.4 million currently but indexed for inflation).
